Food regulator FSSAI warns against sale of breast milk, says commercialization of breast milk is not allowed

The Food Safety and Standards Authority of India (FSSAI) issued a warning on Friday (May 24) against the sale of breast milk and its products, saying commercialization of breast milk is not allowed in India.

“This office receives declarations from various registered associations regarding the commercialization of breast milk and its products. In this regard, it may be noted that FSSAI has not permitted processing and/or sale of breast milk as per the FSS Act, 2006 and the rules/regulations made therein,” the note said.

Any violation of this directive may result in action against food business operators (FBOs) under the FSS Act, 2006 and its rules and regulations, the top food regulatory body added.

“it is recommended to immediately cease all activities related to the commercialization of breast milk and its products. Any violation of this may result in action being initiated against the FBO under the FSS Act, 2006 and the rules/regulations made thereunder,” the circular said.

Further, the Food Regulatory Agency has stated that any violation of this order may result in action against Food Business Operators (FBOs) under the FSS Act, 2006 and related rules and regulations.

FSSAI has also advised the licensing authorities not to approve such establishments selling human milk. “The State and Central Licensing Authorities should ensure that no license/registration is granted to such food business operators involved in the processing or sale of ‘breast milk/human milk’.

According to national guidelines for lactation management centers (LMCs) in public health facilities, human milk cannot be used for commercial purposes. It should be administered to newborns and infants only in health care facilities equipped with comprehensive lactation management centers, following all recommended procedures.
