MiCA: EBA finalizes regulation at European level!

The European Union has taken a decisive step in cryptocurrency regulation with the EBA finalizing the MiCA framework. This framework establishes harmonized rules on cryptocurrencies at EU level. It therefore provides legal certainty for digital assets not covered by applicable rules.

In addition, EBA will facilitate the monitoring and evaluation of emerging crypto-assets and use cases across the European Union. With improved monitoring, the EBA can equip itself with the necessary information to ensure effective enforcement of MiCA requirements! It will also monitor new or emerging activities that may be outside its scope but may need to be incorporated in the future.

Regulatory cryptocurrency revolution in Europe!

MiCA represents a significant step towards regulating cryptocurrency markets. It offers a harmonized and dedicated approach at European Union level. And this with detailed rules regarding cryptocurrencies and related activities and services. Additionally, the harmonized MiCA framework regulates cryptocurrency services that are not yet covered by EU legislation.

The MiCA Regulation therefore aims to promote market integrity and financial stability by regulating public offerings of cryptocurrencies. But also by ensuring that consumers are better informed about the risks involved. During the implementation phase of MiCA, ESMA (in close cooperation with the EBA, EIOPA and the ECB) is conducting public consultations on a number of technical standards, which will be published in three series. The aim is to present draft measures that meet social requirements.

Finally, this regulatory framework is the first in the EU. MiCA will be directly applicable in all Member States, including Malta, without the need for transposition at national level. This marks an important step in recognizing cryptocurrencies as an integral part of the financial system and protecting investors in the digital space.
