The decision on the FTC non-compete challenge will be made without a hearing

A federal judge in Texas said she will decide on a challenge to the Federal Trade Commission’s near-total non-compete ban without a hearing.

A hearing on “the requested injunction is not necessary,” Ada E. Brown of the U.S. District Court for the Northern District of Texas said in a brief order filed late Thursday evening.

Brown said she would make a decision by July 3 on a motion for a preliminary injunction seeking to block the regulation, which is expected to go into effect in September. This ruling will carry significant weight because non-competition provisions are applied across the country.
