US says post-Sackett EPA water agency is ‘regulatory patchwork’.

Twenty-four states led by West Virginia on Tuesday doubled down on their claims that the Biden administration is ignoring the U.S. Supreme Court’s ruling on Sackett v. EPAwhich ended the protection of many wetlands.

Position of the Environmental Protection AgencySackett regulations adjusting the Biden administration’s January 2023 definition of waters of the United States, or WOTUS, constitute a “regulatory patch,” according to the ruling, the states said in their response to the federal government and tribes’ request for summary judgment West Virginia v. EPA.

The EPA is scheduled to file a response to these claims on July 26.
