OFFICE MEMORANDUM

Subject:- Periodic review of Central Government employees to strengthen administration under Fundamental Rule (FR) 56(j)/(l) and Rule 48 of the CCS (Pension) Rules, 1972 (now amended as Rule 42 of the CCS (Pension) Rules, 2021) – reg.

The undersigned is to refer to the subject matter mentioned above and state that instructions have been issued from time to time for the conduct of a periodic review of the performance of Government servants for the purpose of determining whether a Government servant should remain in service or be prematurely retired from service, in the public interest. , in accordance with the relevant provisions of the Basic/Pension Policy referred to in the topic mentioned above. Apart from various instructions/guidelines issued in this regard, the DoPT in its OM No. 25013/03/2019-Estt.A-IV dated 28/08/2020 (copy attached) has issued comprehensive and consolidated guidelines detailing the procedures to be followed for identification of cases of premature retirement as per FR 56 (j)/(l) and Rule 48 CCS – (Pension) Regulations enjoining all Ministries/Departments to strictly adhere to the content of the said OM and ensure its wide dissemination to all concerned. Similarly, in respect of strengthening of administration through periodic reviews under FR 56(j) in respect of autonomous institutions and statutory bodies, OM DoPT No. -26012/8/2022-Estt.A-lV dated 20.12. Reference may be made to .2022 and OM No. 25013/1/2016-Estt.A-IV dated 11.03.2016 respectively (copies attached).

It may be noted that the objective of Fundamental Rule (FR) 56 (j)/(I) and Rule 48 of the CCS (Pension) Rules (now amended as Rule 42 of the CCS (Pension) Rules, 2021) is to strengthen the administrative machinery by developing responsible and effective administration at all levels and to achieve efficiency, economy and speed in the disposal of government functions.

4. The Administrative Ministries/Departments have been repeatedly requested to comply with the guidelines issued in this regard and submit a report in this regard to the Department of Personnel and Training. However, it has been noticed that various Ministries/Departments are not complying with the said guidelines, resulting in delay in identification of Government employees for review under the relevant provisions of FR-56 (j)/(l) and Rule 48 of the CCS (Pension) Rules (now amended as Rule 42 of the CCS (Pension) Rules, 20214).

5. In view of the above, the Ministries/Departments are requested to take immediate action to identify the employees subject to audit under the relevant Fundamental/Pension Rules and ensure that their cases are expeditiously referred for consideration to the duly constituted Audit Committee as per Art. according to existing instructions. Further, all Ministries/Departments are also requested to direct Public Sector Undertakings (PSUs)/Banks, Autonomous Institutions and Statutory Bodies under their administrative control to undertake periodic review of employees as per relevant laws.

6. Further, all Ministries/Departments/Organizations are also requested to strictly follow the schedule mentioned in the DoPT OM dated 28/08/2020 for undertaking performance review of Government officials and employees of PSUs/Banks/Autonomous Local Governments institutions/statutory organizations under their control administration to ensure that employees of questionable integrity or deemed ineffective are not allowed to continue working in the government and submit a report to the DoPT in the format given below by the 15th of every month from July 2024.
