The Supreme Court’s decision in the Chevron case is a victory for regulatory reform

Carl Harris, president of the National Association of Home Builders (NAHB) and a Wichita, Kansas-based custom home builder, released the following statement today following the U.S. Supreme Court’s ruling in the case: Loper Bright Enterprises v. Raimondo which limits the ability of federal regulators to interpret federal regulations:

“Today’s Supreme Court ruling is an important step toward significant regulatory reform because it means that federal agencies can no longer continually change the law – or Congress’s intent – by implementing their own interpretation of statutes, as long as the interpretation is viewed as being ‘reasonable’. “.

“This ruling overturns a previous decision by the nation’s highest court from decades ago that gave the government an unfair advantage when someone challenged a regulation in court. In 1984, the Supreme Court issued an opinion that created the Chevron Deference, giving federal agencies wide leeway in interpreting laws and implementing regulations they deemed reasonable. Today’s ruling overturning Chevron means that federal agencies will now have less authority to impose new regulations that Congress has not expressly authorized.”
