Supreme Court Limits Federal Regulatory Powers, Invalidates Chevron Deference – Presidential Prayer Team

This 40-year-old precedent has allowed federal agencies to interpret unclear congressional rules.

The Supreme Court ruled that federal agencies did not have carte blanche to impose environmental, health or workplace regulations, overturning what was known as the “Chevron Deference,” which was a precedent set by the high court in 1984. At the time, the EPA The Environment Agency had the authority to regulate “stationary sources of air pollution” under the Clean Air Act because congressional law was ambiguous and the agency’s interpretation was deemed reasonable.

The Supreme Court justices issued decisions in two cases involving the Commerce Department involving regulatory authority. In the first case, the majority held that “courts need not, and under the (Administrative Procedure Act) may not, defer to an agency interpretation of a law simply because the statute is ambiguous.” Chief Justice Roberts wrote that Chevron was “a judicial invention that requires judges to disregard their statutory duties.”

The Chief Justice of the Supreme Court maintained that this would not affect previous court decisions based on the “Chevron doctrine.”
