China introduces a law requiring inspection of electronic devices for suspected espionage

A new law came into effect in China on Monday that allows national security authorities to monitor electronic devices on suspicion of espionage.

The Ministry of State Security implements regulations defining powers to combat espionage.

The law specifies procedures for monitoring mobile phones, personal computers and other devices of individuals and organizations.

This law requires officials to prepare notifications with the consent of national security authorities at the municipal level or higher.

However, the law allows officials to carry out on-site inspections in urgent cases if they obtain permission and explain their authority.

The ministry emphasizes that the purpose of the law is to prevent illegal activities that threaten national security.

Analysts say authorities will use the law to insist that their inspections are legal.

President Xi Jinping’s administration has put national security first. It began enforcing a revised counterintelligence law last July to tighten repression. The international community has been concerned about the arbitrary implementation of the law.
