Sultan has no constitutional authority to make appointments – Sokoto government – OsunDefender

The Sokoto state government has said that the Sultan of Sokoto has no constitutional authority to make appointments.

The Commissioner for Justice, Barrister Nasiru Binji, stated this at a public hearing on the Sokoto Local Government and Chieftaincy Act 2008 held on Tuesday.

Binji said the state’s chieftaincy law is inconsistent with the Nigerian Constitution.

He found that section 76(2) of the Act was inconsistent with section 5(2) of the Constitution of 1999, as amended.

According to him, “Section 5(2) of the Constitution provides that the executive power of appointment in the State shall be vested in the Governor directly or through his Deputy, Commissioners or any Government Agent appointed by the Governor.

“Thus, there is no power vested in the Sultanate Council to make appointments. Section 76(2) of the Sokoto Local Government and Chieftaincy Law gives the Sultanate Council the power to appoint heads of districts and villages in the state, but with the consent of the incumbent governor.

“So this section is inconsistent with the 1999 Constitution as amended and therefore cannot stand. Because the power of appointment is the executive power and who exercises it, is it not the governor? That is the reason for this amendment. To correct the mistake of the past.”
