URGENT: Court gives Kano judges 48 hours to resign over Ganduje investigation

Kano State – The Kano High Court has given Justice Farouk Lawan Adamu and Justice Zuwaira Yusuf a two-day ultimatum to resign from their positions.

Adamu is the chairman of the Commission of Inquiry into the Recovery of Misappropriated Public Assets, while Yusuf is the chairman of the Commission of Inquiry into Political Violence and Missing Persons.

Judge Simon Amobeda gave the judges a two-day ultimatum on Thursday, July 4.

According to the Leadership portal, former governor Abdullahi Ganduje has filed a lawsuit demanding that the court halt the investigation into his administration conducted by the government of Governor Abba Yusuf.

Amobeda said the actions of Governor Yusuf constituted an abuse of power and undermining the sanctity of the judiciary.

The judge said Governor Yusuf appointed the commission of inquiry without appealing to an earlier court ruling that said only the Economic and Financial Crimes Commission (EFCC) or the Independent Corrupt Practices Commission (ICPC) could investigate Ganduje’s case.

He added that judges risk not receiving payments from the first defendant (the National Council of the Judiciary) (salaries, allowances and benefits) intended for court bailiffs.

“Having accepted the executive appointments as Chairmen of Commissions of Inquiry, having relinquished their judicial functions and having converted their courtrooms into places for the exercise of the executive functions assigned to them by the Governor of Kano State, they cannot at the same time continue to hold office as Judges of the High Court of Kano State and cannot be entitled to the salaries and allowances of judicial officers as fixed by the 2nd defendant and paid by the 1st defendant.”
