Judge denies MLB players union’s request to affirm arbitration decision against Bad Bunny

NEW YORK (AP) — The Major League Baseball Players Association has lost a bid to convince a federal judge to approve an arbitration decision rejecting an attempt by an agent for Bad Bunny’s sports company Rimas to block his decertification by the union.

U.S. District Judge Lewis J. Liman wrote Thursday that the arbitrator’s decision was not final in the case and was not subject to judicial approval. The discipline remained in effect while the appeal is heard by a different arbitrator.

The union revoked the certification of agent William Arroyo and denied certification applications from Rimas co-owners Noah Assad and Jonathan Miranda on April 10, citing alleged violations of agent regulations. The three individuals were barred from reapplying for certification for five years, and the union imposed a $400,000 fine and said certified agents cannot work with Rimas, the three individuals or any affiliated entities.

Rimas was founded in 2021 with the intention of representing Latin players.

The players’ union alleged that Rimas employees “offered and delivered gifts to players they did not represent, including, but not limited to, VIP tickets to `Bad Bunny’ concerts and access to a suite at a Phoenix Suns game.” The union also found that the agents violated the rules “by delivering, causing to be delivered, or promising to deliver money and/or other things of value to players in order to induce or encourage players to use their services as agents.”

Arbitrator Michael H. Gottesman on April 19 denied a motion for a temporary restraining order while Arbitrator Ruth M. Moscovitch hears an appeal by Arroyo, Assad and Miranda regarding the validity of the discipline. Moscovitch also denied a motion to stay the sentence on July 7.

The union filed a motion in the U.S. District Court in Manhattan seeking confirmation of Gottesman’s decision.

“Arbitrator Gottesman’s three-page, emailed decision is not an affirmative award,” Liman wrote in the 17-page decision. “The award, by its terms, did not finally and conclusively resolve all of the issues raised by the parties in the arbitration.”

Rimas Sports, operating under the corporate name Diamond Sports LLC, sued the union in federal court in San Juan, Puerto Rico, accusing it of violating Puerto Rico general tort law and illegally interfering with player representation agreements.

Rimas declined to comment on the decision, spokeswoman María de Lourdes Martínez said. The union did not immediately respond to a request for comment.
