Musk sues Ørsted for boycotting X

Elon Musk has sued energy company Ørsted, accusing it of agreeing to an illegal boycott of Platform X, according to the platform’s managing director Linda Yaccarino.

On Tuesday (6 August), X filed an antitrust lawsuit against the named companies, including Ørsted, which allegedly “conspired to boycott X”.

The lawsuit, filed in Texas, includes other members of the Global Alliance for Responsible Media (GARM) such as CVC Health, Mars and Unilever, as well as the trade group behind GARM, the World Federation of Advertisers.

The statement said the boycott had resulted in the loss of “billions of dollars in advertising revenue” for the X platform and that the defendants had acted against their own economic interests, as part of a conspiracy against the platform, in violation of U.S. antitrust law.

In her post on X, Yaccarino added that “no small group of people should be able to monopolize what is monetized. This group cannot match the power of our users.”

The World Federation of Advertisers launched the GARM initiative in 2019 to “help the industry address the challenge of illegal or harmful content on digital media platforms and its monetization through advertising.”

Christine Bartholomew, an antitrust expert and professor at the University at Buffalo Law School, said: Reuters Agency that it will be difficult for X to prove that this is an unlawful boycott. The social media platform will have to prove that each advertiser has joined a genuine boycott agreement.

“Proving this requirement is no small feat” in cases where an agreement can be implied, she added.

In other news, Ørsted has piloted new technology at its Gode Wind 3 offshore wind farm in Germany, Power Technology announced last month.

A new wind farm technique reduces underwater noise, leading to less environmental disturbance. The patented jet technology was tested on three monopiles at the 242 MW Gode Wind 3 site.
