Cochin: Ernakulam District Consumer Disputes Redressal Commission directed United India Insurance Company pay compensation Rs 6.81 lakh to a customer who was denied compensation for his car accident. Khaja Mueenudeen, a resident of Kaloor, filed a complaint against the insurance company for rejecting the claim. The company cited technical reasons and delay in informing the company about the accident.
The complainant, a businessman from Thiruvananthapuram, currently residing in Ernakulam, has stated in his complaint that his car, driven by a driver, met with an accident near Vytilla flyover. The complainant, on being informed by the driver, took the car to Peninsular Honda, service centre at Maradu. On returning to Ernakulam, the complainant was advised to claim compensation for total loss due to major damages.
He filed a claim on 04.06.2020. The insurance company sought clarification regarding the toll bills and the gate register of the apartment. The complainant explained that the toll bills were not kept as the drivers took internal routes to save on tolls and the vehicle movement was not recorded in the apartment register due to parking on the lawn and negligent registration during the Covid period.
The complainant alleged that the insurance company was using this explanation as an excuse to delay and deny a valid claim. Due to the delay, the complainant and his family had difficulty finding safe transportation during the pandemic and were faced with financial constraints in purchasing another car.
The forum, comprising chairman DB Binu and members V Ramachandran and TN Srividya, said the action of the insurance company was unfair.
The forum ordered the insurance company to pay Rs 6.26 crore insurance claimRs 40,000 compensation and Rs 15,000 towards legal costs within 45 days.
