NASCAR Charter drama escalates as legal battle with Michael Jordan’s team looms

The controversy surrounding NASCAR’s new charter agreement has intensified, shining a spotlight on 23XI Racing and Front Row Motorsports, who have yet to sign the controversial agreement. Denny Hamlin, often credited as the voice of 23XI Racing, has been particularly vocal about the perceived inequality.

“Yeah, that’s a threat,” Hamlin said when asked by Motorsport about the terms of the charter agreement. “That’s if you’re talking negatively. If they don’t like what you’re saying, yeah, they try to reserve the right.”

It is clear from Adam Stern’s analysis that these teams are not happy with the restrictions the new statute places on them.

“Concerns some teams have about the fresh charter contract include whether they will have limited influence over costly rule changes and whether there will be new clauses that will impact their traditional relationships with drivers (and) ownership of their intellectual property,” Stern wrote on X (formerly Twitter).

Negotiations that were originally supposed to end before the Daytona 500 dragged into Week 2 of the NASCAR playoffs without resolution. The situation is serious, and now both 23XI and FRM are putting themselves in a very difficult position by attacking NASCAR.

The stakes are high, and with talk of a legal showdown growing, the situation bears the hallmarks of a major institutional challenge for the sport. The hiring of renowned antitrust attorney Jeffrey Kessler by 23XI Racing suggests it is seriously considering legal action, likely to address allegations of unfair practices and coercion. Kessler, known for his role in reshaping the NCAA Name, Image, and Likeness rules, could potentially lead the antitrust lawsuit, indicating that 23XI Racing is preparing for a formidable legal battle.

This drama is further complicated by accusations from 23XI and FRM regarding the treatment of teams that signed the statute.

If these accusations are proven to be true, they could have serious implications for NASCAR’s governance and future team contracts.
