Oil and gas company challenges EPA’s renewable fuels ruling

Oil and gas company REH Co. on Wednesday challenged the Environmental Protection Agency’s 2019 decision to deny a Wyoming refinery an exemption from renewable fuel standards.

The Company informed the United States Court of Appeals for the Tenth Circuit that it could file the appeal five years after the denial because 60 days had passed since the District Court’s relevant decision in the case of REH’s Sinclair Wyoming Refining Co.

In its July opinion, the court reversed another EPA decision on Sinclair’s 2018 waiver request, “making the challenge to the 2019 denial again subject to review,” REH said.
