A judge in the U.S. District Court for the Eastern District of Virginia declined to grant summary judgment to Alphabet’s Google. The tech giant is facing allegations from the US Department of Justice that it has a monopoly on online advertising technology. Google now faces trial over claims of illegal domination of the online advertising technology market. The company has previously argued that antitrust laws do not prohibit companies from refusing to deal with competitors and that regulators have not accurately defined the ad technology market.

Last year, the Department of Justice and a coalition of states sued Google. They claimed the company was illegally monopolizing digital advertising and charging users excessive fees. The lawsuit primarily seeks to break up Google’s digital advertising business to allow for more competition.

U.S. District Judge Leonie Brinkema, who is scheduled to preside over the Sept. 9 trial, also blocked a former FBI agent who served as a cybersecurity consultant for Google from testifying as an expert at the trial.

Google won a narrow victory in the case last week when Judge Brinkema allowed the trial to proceed without a jury. This came after the company settled claims that its conduct harmed the US government. The court filings did not provide a reason for the judge’s denial of Google’s motion for a default judgment. A Justice Department spokesman declined to comment on the matter.
