James Weingarten joins Milbank’s Antitrust and Competition Group

Milbank limited liability company is pleased to announce the addition James H. Weingarten as a partner in Washington, further strengthening the firm’s global antitrust and competition group and broader litigation group. Mr. Weingarten joins Milbank from the Federal Trade Commission, where he most recently served as Chief Hearing Counsel for the Bureau of Competition. As general counsel, he was one of the most senior trial lawyers representing the U.S. government in antitrust matters.

In recent years, Milbank has significantly expanded its global antitrust and competition group, including new partners Rich Parker, Grant Bermann, Adam Di Vincenzo and special advisor Daniel Rosenthal IN Washingtonand partners Andrea L. Hamilton and Ajal Notowicz London.

Mr. Weingarten’s practice will focus on representing clients facing government antitrust investigations and prosecutions and private antitrust proceedings. He will advise clients both on assessing and mitigating the risk of antitrust disputes, as well as representing them before competition protection authorities and in court.

Schaeffer.

During his time at the FTC, Mr. Weingarten served as the first trial chair and led teams that developed and tried antitrust cases challenging both mergers and alleged violate antitrust laws. He advised the Commission’s management on litigation strategy and policy and worked closely with Attorneys General and international competition agencies.

His experience in merger disputes includes, among others: presiding over the FTC’s challenges to Microsoft Corp $69 billion acquisition of Activision Blizzard, Inc. and leading research teams challenging mergers across industries, including healthcare, pharmaceuticals and technology. He also served as lead counsel in the successful challenge to Nvidia Corp.’s proposal. by the FTC $40 billion acquisition of ARM Holdings. Before leaving the FTC, Mr. Weingarten was lead counsel on the FTC’s complaint against Kroger $26 billion Albertsons takeover. Mr. Weingarten also has extensive experience handling Sherman Act matters, including: FTC v. Vyera Pharmaceuticals, Inc., FTC v. Abbvie, Inc. AND In Impax Labs, Inc. again. Lately in FTC v. Syngenta Corp.successfully opposed defendants’ motion to dismiss an FTC complaint alleging unlawful monopolization in the pesticide industry.

Prior to joining the FTC, Mr. Weingarten was a trial lawyer in private practice where he represented businesses and individuals in complex civil disputes and trials. He was a member of several trial teams, including the team that won a full defense verdict in In re Nexium (esomeprazole) jury trial, the first pharmaceutical case requiring late payment to go to trial after a landmark Supreme Court ruling Actavis decision. He also served as the first chairman of the defense in a felony conspiracy case that resulted in a jury verdict acquitting his client of all felony charges.

Mr. Weingarten received his J.D., magna cum laudeWith Harvard Law School and his bachelor’s degree, magna cum laudeWith Yale University. After graduating from law school, he clerked for the then chief justice Danny J. Boggs United States Court of Appeals for the Sixth Circuit.
