A racist thug adopted a boxing stance and said “go, go” to an Aldi security guard who was escorting him from a store.

Frankie Denham, from Canterbury, also launched a tirade of abuse at the employee and store manager after a drinking session, when he was ordered to leave the town’s supermarket.

During the confrontation, the 28-year-old claimed he had been “misidentified” as a banned shoplifter and began “kicking off”.

He told the guard to “go back to your own country” and hurled other obscenities, including homophobic slurs, at staff as he was sent off.

Denham, of Bingley Court, was later charged and admitted threatening behavior and racially aggravated threatening behavior at the earliest opportunity.

Returning to Margate Magistrates’ Court on October 14 to learn his fate, prosecutor Dylan Bradshaw said: “This concerned an incident at the Aldi store in Canterbury at around 7.30pm on December 5, 2023.

“The manager had told a security guard that he had asked him to remove him after he went to the refrigerator aisle because he had already been banned from the store.

“He started shouting about his human rights, then he said, ‘Get the fuck out of my country,’ and then the guard put his hands on him to get him out of the store.

“He was yelling and being racist, then got into a boxing stance and said, ‘go, go’ and continued his stance and started throwing punches, then told him to ‘go back to his own country’ .”

The prosecutor said the security guard wrote a victim impact statement to say he was disappointed to have been the victim of racist abuse and did not deserve to be treated in this way.

A statement from the store manager says he asked the guard to remove Denham from the store because he was a shoplifter. Then, as the guard attempted to remove him, he repeatedly shouted the word “misidentified.”

The manager also told police he heard Denham shouting phrases such as “go back to Palestine and Iraq” as well as “f***** and big ****”. He said it was painful to hear the homophobic and shameful abuse and for his staff to hear it too.

The prosecutor told magistrates their sentencing decision should be improved because not only had Denham used aggravated racist language, but he had also made homophobic slurs.

Roger Davies, defending, told the court his client had been using the store for around three years.

He added: “He shops there every week and is good friends with the staff. He’s not banned, he’s not a shoplifter and that really upset him. It was a case of mistaken identity.

“He had a little too much alcohol and when he drinks it he sometimes expresses himself in a way he shouldn’t.

“He was removed from the store but disputes the reason.

“He stayed and waited for the police (on scene) and the words he used – he knows they are not acceptable.

“He has a drinking problem and is on universal credit.”

The court also heard that Denham told a probation officer that he usually drank between four and five cans of alcohol every day and that the officer suggested that six months of alcohol treatment might help him. help get rid of this habit.

Magistrates said the offenses were serious enough to warrant a community order and his offending was clearly linked to his alcohol problem.

As a result, they gave him a 12-month order which will see him complete six months of alcohol treatment and he will also have to attend 10 rehabilitation sessions with probation.

He was also ordered to pay £75 compensation to the security guard and store manager.

They also told Denham the community order would have lasted six months, but they increased the sentence due to the racial and homophobic elements of the offences.
