First Amendment to the Food Safety and Standards (Prohibition and Restrictions on Sale) Regulations, 2024

The Food Safety and Standards Authority of India (FSSAI) has issued an amendment to the Food Safety and Standards (Prohibitions and Restrictions on Sale) Regulations, 2011, effective from the date of publication in the Official Gazette. These changes primarily focus on multi-source edible oils, which can now only be sold in packages of no more than 15 liters, as specified in the Food Standards and Food Additives Regulations 2011. Additionally , several sub-regulations have been omitted or revised, including the removal of sub-regulation 2.3.8 and specific clauses related to AGMARK certification in sub-regulation 2.3.14. The update also removes certain clauses from Form A and eliminates the requirement for AGMARK certification marks on certain food products.

NOTIFICATION

New Delhi, October 17, 2024

No. REG-11027/2/2022-Regulation-FSSAI.— Whereas the draft Regulations Amendment to the Food Safety and Standards (Prohibitions and Restrictions on Sale) Regulations, 2023 have been published as required by subsection (1) of section 92 of the Food Safety Act, 2006 food safety and standards (34 of 2006) see notification of Food Safety and Standards Authority of India number F.No. REG-11027/2/2022-Regulation-FSSAI of 27th April 2023, in the Gazette of India, Extraordinary, Part III, Section 4, to invite objections and suggestions from all persons who may be affected thereby, before the expiration of sixty days from the date to which copies of the Official Gazette containing the said notifications have been made available to the public;

And considering that the copies of the said Gazette have been made available to the public on the 28th April 2023;

And whereas the objections and suggestions received from the public regarding the said draft regulations have been considered by the Food Safety and Standards Authority of India;

Therefore, in exercise of the powers conferred by section 92 of the Food Safety and Standards Act, 2006 (34 of 2006), the Food Safety and Standards Authority of India hereby makes the following regulations to further amend Food Safety and Standards (Prohibitions and Restrictions on Sale Regulations), 2011, namely:-

REGULATIONS

1. Short title and beginning.- (1) These regulations may be called the Food Safety and Standards (Prohibition and Restrictions on Sale) First Amendment Regulations, 2024.

(2) They enter into force on the date of their publication in the Official Journal.

2. In the Food Safety and Standards (Prohibitions and Restrictions on Sale) Regulations, 2011:

(i) in rule 2.1, in sub-rule 2.1.1, for the third condition beginning with the words “Provided also that the prohibition provided for in rule 2.1.1” and ending with the words “the standard relevant prescribed by these regulations. ”, the following must be replaced, namely:

“Provided further that the prohibition in Regulation 2.1.1 (5) shall remain inoperative in respect of multi-source edible oils specified in clause 24 of sub-regulation 2.2.1 of Food Safety Regulation 2.2 and standards (standards and norms for food products). Food Additives) Regulations 2011 and multi-source edible oils must not be sold in packaging weighing more than 15 liters. » ;

(ii) in rule 2.3, –

(A) sub-rule 2.3.8 shall be omitted;

(B) in sub-regulation 2.3.14,-

(a) subsections (4) and (5) shall be omitted;

(b) in paragraph (11), the words “bearing the AGMARK certification mark” shall be omitted;

(c) in paragraph (13), the words “Bearing the AGMARK certification mark” shall be omitted;

(d) subsections (17) and (18) shall be omitted;

(iii) Form A should be omitted.
