New Delhi (India), October 11: Companies operating in India or conducting related party transactions there should be informed of upcoming transfer pricing deadlines. The Income Tax Act, 1961 sets out regulations for such transactions, and all such activities must be reported by October 31, 2024 using Form 3CEB.

This reporting requirement applies to all business entities, including sole proprietorships, corporations, limited liability companies, and corporations.

Transfer pricing regulation ensures fair pricing for related party transactions. Failure to comply with these rules may result in tax adjustments and penalties.

Key points for businesses:

*All related party transactions in India, regardless of value, must be reported by October 31.

*For international transactions exceeding INR 1 crore, detailed documentation explaining the transaction and price justification is required.

* Companies should review existing agreements with related parties and ensure that prices are consistent with “arm’s length” principles, reflecting the market value of similar transactions between unrelated parties.

Effective transaction planning and structuring, coupled with determining arm’s-length pricing prior to agreements, is essential to strong corporate governance and tax compliance.
