Sustainable and transparent competition protection in the AI ​​space

The authors examine the role of EU competition policy and related EU legislation, such as the EU’s Digital Markets Act (DMA), in the emerging artificial intelligence space. They argue that to address the challenges of artificial intelligence, competition authorities will be able to build on the enforcement experience gained with technology platforms over the last ten years. The ex ante EU regulations on technology platforms will further reduce the risks to effective competition in the artificial intelligence space.

The article begins by describing the role of data and computing power (cloud services) in the development and implementation of artificial intelligence, as well as the concerns and opportunities associated with technology platform ecosystems and artificial intelligence. It then examines how existing competition policy and regulatory instruments in the digital world can address potential competition issues arising from these elements of the AI ​​space. The authors argue that these instruments can be effectively used to meet the challenges posed by artificial intelligence. They call for a gradual and balanced approach to competition policy and regulation in the AI ​​space.
