Consumers File Live Nation and Ticketmaster Class Action Lawsuit Following Department of Justice Suit

Live Nation Ticketmaster Class Action Lawsuit Overview:

  • Who: Abraham Leifer filed a class action lawsuit against Live Nation Entertainment Inc. and Ticketmaster LLC.
  • Why: Leifer claims Live Nation and Ticketmaster monopolized the concerts and live events market when the two companies merged in 2010.
  • Where: The class action lawsuit was filed in federal court in New York.

The new class action lawsuit alleges that Live Nation and Ticketmaster created an unlawful monopoly in the concerts and live events market through their 2010 merger.

Plaintiff Abraham Leifer’s class action lawsuit alleges that Live Nation and Ticketmaster monopolized the market for major concert hall concert promotions and primary and secondary ticketing services for major concert halls.

Leifer claims that Ticketmaster controls the sales of more than 70-80% of all primary ticket sales to major US concert venues, and that Live Nation is strengthening its alleged monopoly by forcing the venues it operates to use Ticketmaster as its “sole primary ticketing agent.”

“Thus, in the primary ticket market, Ticketmaster acts as the sole ticketing intermediary between the event venue and the end consumer,” the class action lawsuit states.

The class action lawsuit was filed with the Department of Justice on the same day filed a lawsuit against Live Nation in connection with the agreement approving the purchase of Ticketmaster.

The class action lawsuit claims that Live Nation and Ticketmaster violated the Sherman Antitrust Act

Leifer seeks to represent the nationwide class of end-users who have purchased secondary tickets on exchanges from a secondary seller who, in turn, purchased a primary or secondary ticket to an event held at a large concert hall in the U.S. from Ticketmaster or one of its directly or indirectly owned affiliates Live Nation since its 2010 merger.

A separate class is offered to indirect buyers from 26 U.S. states, Washington, D.C. and Puerto Rico.

Leifer claims Live Nation and Ticketmaster are violating the rules Sherman Antitrust Act and the antitrust laws of many U.S. states.

Plaintiff seeks a jury trial and seeks declaratory and injunctive relief and awards of statutory, actual, compensatory, consequential, treble, punitive, and nominal damages for himself and all class members.

Live Nation previously agreed to a settlement to resolve the company’s claims artificially high ticket pricesfor alleged violations of New Jersey consumer protection laws.
