The tech giant asked U.S. District Judge Yvonne Gonzalez Rogers to dismiss or limit the sentence, saying recent legal decisions strengthen its arguments. These legal changes came into force after a long-term legal battle with “Fortnite” creator Epic Games.

Judge Rogers’ 2021 decision ordered Apple to allow developers like Epic Games to direct users to alternative payment methods. The ruling was seen as a significant blow to Apple’s lucrative App Store model, which generates significant revenue.

In its latest legal maneuver, Apple cited new rulings from California state courts and the U.S. Supreme Court that it says support its position. According to the company, these decisions show that the App Store practices do not violate antitrust laws.

Apple argued that any injunction should apply only to Epic Games and not benefit other developers, in an attempt to limit the ruling’s broader ramifications.

One of the cases Apple is referencing involves a proposed California consumer class action lawsuit challenging the company’s App Store practices. Another case Apple pointed to is a federal court decision that involved allegations that the Biden administration placed inappropriate pressure on social media platforms to curb misinformation.

Despite Apple’s efforts to challenge the order, Epic Games is still continuing its legal battle. Epic accused Apple of failing to comply with the 2021 court order and asked the court to condemn Apple.

For now, Apple has not commented publicly on its recent lawsuit, and Epic Games has also declined to comment.
