Campbell crafts Massachusetts rules for assisted living

BOSTON (SHNS) – More than 17,000 Bay Staters residing in assisted living facilities could benefit from stronger consumer protections that Attorney General Andrea Campbell’s office is beginning to implement.

Acting through the state’s Consumer Protection Act (Chapter 93A), Campbell’s office said Tuesday that it is seeking public comment as it works to develop regulations “to protect assisted living residents from unfair and deceptive acts and practices, including misrepresentation of available services, fees, and illegal evictions. His office said regulations could require establishments to make certain disclosures about their contract terms, and they could also declare certain illegal acts and practices.

Currently, the state does not have consumer protection regulations that specifically target assisted living residents and facility owners and operators, Campbell’s office said. But Massachusetts has a new law on the books overhauling the state’s long-term care sector, which includes strengthening oversight of nursing homes and other facilities, ensuring basic health services are provided in assisted living facilities and the creation of more rigorous licensing standards.

“Every assisted living resident has the right to live in a safe and livable environment, free from abuse, neglect and exploitation,” Campbell said. “Our seniors deserve to age safely, with dignity and respect, which is why creating consumer protection regulations for assisted living facilities is so important and addresses their advocacy.”

The proposed regulations would be subject to a public hearing and other opportunities for Bay Staters to provide feedback, Campbell’s office said.

Assisted living represents a step on the continuing care ladder for some Massachusetts residents. According to the Attorney General, assisted living facilities are “designed for older adults who can live independently in a home-like environment, but who may need assistance with daily activities such as housekeeping, bathing, bathing or assistance with medication.”
