A bench of chief justice NV Anjarie and justice KV Aravind ordered the State to file its response to the petition filed by one Alam Pasha by November 12.

The petitioner told the Court that the Wakf Act, 1995 did not confer any legal powers on the Wakf Boards to issue marriage certificates and, therefore, the State order issued in August of last year was illegal.

To this, the judges observed orally,

“The Wakf Board of Directors does not have the function of issuing marriage certificates.”
