    This summer, the U.S. Supreme Court overturned deference to Chevron in a 6-3 decision, holding that “courts must exercise independent judgment in deciding whether an agency acted within its statutory authority.” » (1) As a result, courts will now use their own judgment to decide the meaning and intentions of a particular law, which could lead to conflicting decisions and conflicting directives. This will have a profound impact on the healthcare industry, from insurance requirements to hospital reimbursement rates to nursing home care, among others.

    With so much uncertainty and unpredictability, legal experts and academics say there could be a flood of litigation in the years to come. This concern has certainly caused a sensation and sparked debate. So how should compliance professionals prepare and properly respond to all of this?

    Stay informed of regulatory developments

    Compliance work is never static, largely due to the ever-changing regulatory environment and risk landscape. It is therefore imperative that compliance professionals stay informed of all legislative updates that could directly impact your organization’s operations. Signing up for industry newsletters and getting involved in national and regional compliance communities such as HCCAnet and HCCA conferences are an effective way to stay ahead of the curve and have ample time to prepare for the changes to come.

    Consult and collaborate with your legal experts

    It’s no secret that the healthcare industry has always been the subject of intense scrutiny from a wide range of government agencies and public media. There are numerous laws and regulations for every sector and every aspect of the healthcare delivery process. Due to the legal complexities and potential implications of even the slightest deviation from standard procedures, it is not only useful but necessary for compliance professionals to work with legal experts on issues such as interpretation and implementation newly published rules, revised regulations, or updated guidance.

    Even though cases may be overturned, the ups and downs of the legal world do not fundamentally change the work compliance professionals do—that is, focusing on and ensuring the quality of patient care. It is essential that we do not lose sight of what we are pursuing and defending.
