Delhi High Court rejects electric vehicle company Okinawa Autotech’s plea against show cause notice

A bench of chief justice Manmohan and justice Tushar Rao Gedelaobserved that a judicial court can only intervene on show cause notices in rare and exceptional cases, for example when the notice is issued without jurisdiction or in cases of abuse of rights.

In this case, the Court was not convinced by Okinawa’s contention that the show cause notice was issued in a biased manner or with a “predetermined spirit” of blacklisting.

It therefore rejected Okinawa’s challenge to the September 11 show cause notice issued by the Union Ministry of Heavy Industries and Public Enterprises.

“This Court finds no reason to prohibit the show cause notice at this stage. In any case, the appellants may raise all their arguments before the authority while filing the reply to the show cause notice, taking all any objections available with them. said the Court.
