UAE: New committee to assess properties and resolve disputes in Ajman – News

Valuation of properties in Ajman will now be carried out only by the newly established Valuation and Reconciliation Committee, says a new decree issued on Thursday.

In accordance with the provisions of the decree issued by Sheikh Humaid bin Rashid Al Nuaimi, Ruler of Ajman and member of the Executive Council, the committee was restructured, replacing the former “Committee for Assessment and Reconciliation Affairs in the Emirate of Ajman”, which was established by UAE Decree No. (2) of 2011.

The committee’s duties include valuing properties upon request of the parties concerned, in accordance with standards and regulations approved by the Department of Land and Real Estate Regulation, resolving disputes between the parties involved, facilitating the reconciliation of property values ​​and approval of amicable settlement agreements. The committee will also issue official property valuation certificates.

The commission will report administratively to the president of the land and real estate regulation service. Its members will be appointed by decision of the Crown Prince of Ajman, selecting individuals with expertise and competence in the committee’s field of work. The duration of membership will be three years and renewable.

The decree also allows the committee to settle amicably disputes between heirs concerning inherited real estate, at their request, after verification of the certificate of succession issued by the competent court. If a settlement is reached, a settlement agreement will be signed by the parties involved and the heirs must follow legal procedures to implement the agreement, in accordance with applicable laws. If an amicable settlement is not possible, the matter will be brought before the competent court. The committee is required to make its decisions regarding the settlement within 90 days from the date of receipt of the application.

According to the decree, the commission will issue land assessment certificates in accordance with the standards and regulations of the Department of Land and Real Estate Regulation. Certificates will only be valid for three months from the date of issue and will be considered final unless proven fraudulent by legal means.

Any person concerned may request a revaluation of the property within 30 days following notification of the assessment, according to procedures approved by the Department of Land and Real Estate Regulation.

The new decree repeals UAE Decree No. (2) of 2011 regarding the regulation of the Assessment and Reconciliation Affairs Commission in the Emirate of Ajman. It also supersedes all conflicting provisions of other legislation.
