Guidelines for Issuing ETA for Wireless Equipment

On October 22, 2024, the Central Board of Indirect Taxes and Customs (CBIC) issued Instruction No. 24/2024-Customs, dealing with the process of obtaining Equipment Type Approval (ETA) for wireless equipment exempt from licensing. This initiative aligns with the Department of Telecommunications Office Memorandum, dated September 9, 2024, which allows applicants to obtain ETAs based on self-declaration, thereby facilitating business in the telecommunications sector. To apply, individuals must submit their application through the SARAL Sanchar portal, providing the necessary documents and fees. Once approved, applicants can upload their ETA certificates directly from the portal. Additionally, ETA holders are required to obtain a no-objection certificate or other clearances from the Directorate General of Foreign Trade (DGFT) before importing the equipment, thereby emphasizing their responsibility to comply with all relevant import regulations. The new instructions also amend previous guidance on the matter, urging customs officials to disseminate this information to ensure compliance and avoid confusion. Any difficulties encountered in implementing these guidelines should be reported to CBIC.

Purpose: Issuance of an Equipment Type Approval (ETA) for license-exempt wireless equipment.

Madam/Sir,

Reference is requested to be made to the Memorandum of the WPC Wing Office, Department of Telecommunications (DoT), Ministry of Communications, issued vide R-11017/01/2018-PP (Part 1) dated 09-09 -2024 regarding the issuance of equipment type approval. (ETA) for license-exempt wireless equipment (copy attached) to facilitate business in the telecommunications sector.

2.1 See the MO above, it is stated that all applications for Equipment Type Approval (ETA) for wireless equipment, which have been exempted from licensing through various Gazette Notifications published from time to time to another, will be granted to the applicant independently. basis of declaration.

2.2 To avail this facility, it is stated that candidates must submit their applications on the SARAL Sanchar portal (https://saralsanchar.gov.in), with all required documents and fees. Once the application is successful, candidates can download the ETA certificates from the portal.

3. It has also been clarified in the said MO that these ETAs will be granted to ensure compliance with the RF regulations. Therefore, ETA holders must obtain a no-objection certificate or other clearances (if applicable) from the Directorate General of Foreign Trade (DGFT) before importing the equipment. It is the sole responsibility of ETA holders to ensure compliance with all import regulations and requirements stipulated by the DGFT.

4. It is requested to create awareness among the officers under your jurisdiction by issuing an appropriate standing order/public notice.

5. Earlier Instructions no. 16/2022-Customs of 07.21.2022 the stands have been modified at this point.

6. Difficulties, if any, may be brought to the attention of the Council.

In a bid to promote ease of doing business in the telecommunications sector, the competent authority has decided that henceforth all applications for Equipment Type Approval (ETA) for wireless equipment. which have been exempted from licensing through various Gazette notifications issued from time to time. is granted to the applicant on the basis of a self-declaration.

2. Applicants must submit their application on the SARAL Sanchar portal (https://saralsanchar.govint), with all required documents and fees. Once the application is successful. candidates can download ETA certificates from the portal.

3. These ETAs must be granted to ensure compliance with RF regulations. SO. ETA holders must obtain a no-objection certificate or other clearances (if applicable) from the Directorate General of Foreign Trade (DGFT) before importing the equipment. It is the sole responsibility of ETA holders to ensure compliance with all import regulations and requirements issued by the DGFT.
