Martha Koome constitutes a three-judge bench to hear Gachagua’s case challenging his impeachment

  • On Monday, October 14, Chief Justice Martha Koome formed a three-judge panel to hear and decide issues related to petitions challenging the impeachment of MP Rigathi Gachagua.

Nairobi – Chief Justice Martha Koome has appointed three judges to hear and decide petitions filed by Vice President Rigathi Gachagua opposing his impeachment.

On Monday, October 14, Koome appointed Justices Eric Ogola, Anthony Mrima and Frida Mugambi to hear the petition filed by the embattled vice president.

In his directive issued to the Constitutional and Human Rights Division of the High Court in Nairobi under Petition No. E522 of 2024, Koome followed the orders issued by Justice Lawrence Mugambi.

”Following orders issued by the Hon. Mr Justice LN Mugambi, on October 11, 2024, I appoint to hear and decide this petition as well as petitions E509/2024, E537/2024, E528/2024, E525/2024 and E506/2024,’ Koome said.

Justice Ogola will head the judiciary appointed by the Chief Justice.

Koome’s moves come even as Gachagua’s impeachment fate is set to be discussed and determined before the Senate plenary on Wednesday and Thursday this week.

Justice Mugambi had ruled that the petition filed by Gachagua and five other separate cases raised serious constitutional questions that required the attention of more than one judge.

He said the declaration of an odd number of judges who will be appointed to decide the case will serve as a benchmark for future undertakings.
