Man charged with stick attack in Boulder – Boulder Daily Camera

A man suspected of hitting another man in the head with a 3-foot stick was arrested Sunday in Boulder.

Daniel Joseph Gardner, 38, was arrested on suspicion of first-degree assault, second-degree assault, drug paraphernalia and unlawful possession of a controlled substance.

He is scheduled to be arraigned Wednesday and is currently being held on $5,000 bail.

According to the affidavit, at 10:10 a.m. Sunday, officers were dispatched to an assault near 30th Street and Shadow Creek Drive.

A witness said he saw a man covered in blood running out of the woods, pursued by a white man in a dark jacket.

The victim was taken to Boulder Public Health for stitches to a laceration on his forehead. He told police he came out of his tent when Gardner hit him in the face with a baseball bat or large stick. He also said he ran toward 30th Street with Gardner in pursuit, according to the affidavit.

In an interview with police at the hospital, the wounded man said that the day before the attack, Gardner was angry about feces that were found on a trail near their camp and said to him: “I will kill you, I will cut your eyeballs.”

According to the affidavit, while searching the area, officers found a three-foot-long stick with the word “Wizard” written on it and found “what appeared to be fresh drops of blood 3 to 5 yards from where the stick was found.”

When questioned by police, Gardner initially denied any involvement in the attack, saying he had already left the camp when the man was wounded. He also said the man may have fallen on a rock or that the injury may have been self-inflicted, according to the affidavit.
